These Terms of Service ("Terms") govern your access to and use of the Agglo platform operated by ECO ("we," "our," or "us"). By accessing or using the platform, you agree to be bound by these Terms.

Eligibility and Account Registration. You must be at least 18 years of age and have the authority to enter into a binding agreement on behalf of your business entity. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Subscription Plans and Billing. Platform access is billed on a monthly subscription basis with a minimum 3-month initial commitment period. Setup fees are non-refundable. After the minimum period, subscriptions continue month-to-month and may be cancelled with 30 days written notice.

ECO/Tenant Boundary. Agglo is a software platform, not a commerce participant. We do not process payments on behalf of Tenants. Each Tenant is responsible for connecting their own payment processor credentials. All funds collected through payment links flow directly between Tenant and their customers via the Tenant's processor account. ECO has no involvement in Tenant–customer disputes, chargebacks, or refund decisions.

Acceptable Use. You may not use the platform to transmit unlawful, fraudulent, or harmful content; to violate the rights of third parties; or to circumvent technical restrictions. We reserve the right to suspend accounts that violate these terms.

Intellectual Property. All platform software, design, and documentation are proprietary to ECO. This agreement grants you a limited, non-exclusive, non-transferable license to access and use the platform during your subscription term. You retain all rights to your own data.

Limitation of Liability. To the maximum extent permitted by applicable law, ECO's total liability to you for any claim arising out of or relating to these Terms or the platform shall not exceed the amounts paid by you in the 12 months preceding the claim.

Governing Law. These Terms are governed by the laws of the state indicated in your signed order form, without regard to conflict of law principles. Disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association. Final legal copy will appear here before the platform is open to external clients.
